Welcome to Propie, your comprehensive real estate management platform. By using our services, you agree to the following terms and conditions.
1. Introduction
Welcome to PropPie (“App”), a property management platform operated by Fixam Africa (“Company”). The App enables tenants to make rental payments to landlords, landlords to conduct tenant background checks, and the sending of automated WhatsApp reminders.
By accessing or using the App, you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree, you must not use the App. These Terms apply to all users, including tenants and landlords (“Users”).
2. Definitions
- “App” means PropPie and all related services provided.
- “User” means any individual or entity using the App, including Tenants and Landlords.
- “Tenant” means an individual renting property via the App.
- “Landlord” means a property owner or manager using the App.
- “Services” include rent payment processing, tenant background checks, and automated WhatsApp reminders.
- “Third-Party Providers” are external service providers integrated into the App, such as payment processors, background check agencies, and messaging platforms.
- “Personal Data” has the meaning assigned under the Nigeria Data Protection Act, 2023 (NDPA).
3. Acceptance of Terms / Eligibility
- By creating an account or using the Services, you accept these Terms. You represent that you are 18 years old, legally capable and authorised to enter into a binding contract.
- Users agree to provide accurate and complete registration details, comply with Know-Your-Customer (KYC) requirements, and maintain account security.
- Users are responsible for all activities on their accounts and must not share login credentials.
4. Scope of Services
PropPie provides:
- Payment Processing – tenants can pay rent through integrated payment partners.
- Background Checks – landlords may request tenant background checks (including credit, employment, and criminal records) subject to tenant consent.
- Automated Reminders – WhatsApp notifications regarding rent payments and tenancy obligations.
The Services are dependent on Third-Party Providers and may be subject to interruptions beyond our control. PropPie is not a party to tenancy agreements and does not act as a property agent.
5. User Responsibilities
- Tenants must make timely payments, provide truthful information, and consent to background checks when requested.
- Landlords must use background check information lawfully, comply with tenancy and housing regulations, and must not use the App for discriminatory purposes.
- All Users must not engage in fraud, misuse the App, or violate any applicable laws or these Terms.
6. Payment Terms
- Tenants can pay rent through our partner providers. Payments are processed via authorised payment providers. Users are responsible for transaction fees, which will be disclosed before payment.
- Refunds, if applicable, are subject to the Landlord’s discretion and Third-Party Provider policies.
- Users are responsible for applicable taxes.
- PropPie is not liable for payment disputes, chargebacks, or errors caused by Third-Party Providers.
7. Anti-Money Laundering (AML) and Compliance
Users must comply with the Money Laundering (Prevention and Prohibition) Act 2022 and all applicable Central Bank of Nigeria regulations. PropPie may request additional KYC documents, restrict or suspend accounts, and report suspicious activities to regulators where required by law.
8. Background Check Terms
- Tenants must provide explicit consent before landlords may request background checks.
- Checks may include criminal records, employment history, credit information, and references.
- Background checks are performed by licensed Third-Party Providers, subject to their terms.
- Results are disclosed to the requesting landlord only.
- Landlords agree not to misuse or unlawfully store background check data.
9. WhatsApp Messaging Terms
- By registering on the App, Users consent to receive automated WhatsApp messages relating to payments and tenancy reminders.
- Users may opt out of such notifications by updating their preferences.
- Messages are sent via WhatsApp Business API and subject to WhatsApp’s policies.
- PropPie is not responsible for delays, interruptions, or WhatsApp’s handling of data.
10. Privacy and Data Protection
- PropPie collects and processes Personal Data in line with the Nigeria Data Protection Act, 2023.
- Lawful bases for processing include contract performance, consent, and compliance with legal obligations.
- Users have rights under the NDPA, including access, rectification, erasure, portability, and withdrawal of consent.
- PropPie will notify the Nigeria Data Protection Commission and affected users of any reportable data breaches.

11. Security
PropPie shall implement reasonable technical and organisational safeguards but does not guarantee absolute security. Users are responsible for protecting their devices and reporting unauthorized account use.
12. Intellectual Property
All intellectual property in the App, including software, logos, and content, is owned by PropPie or its licensors. Users are granted a limited, non-exclusive licence to use the App for lawful purposes.
13. Third-Party Services
The App relies on Third-Party Providers. Use of their services is subject to their separate terms and conditions. PropPie is not liable for the acts or omissions of Third-Party Providers.
14. Limitation of Liability and Indemnity
- The App is provided on an “as is” basis without warranties.
- To the extent permitted by law, PropPie’s liability is limited to direct damages not exceeding the fees paid by the User in the preceding twelve (12) months.
- PropPie is not liable for indirect, incidental, or consequential damages, including data loss or third-party actions.
- Users agree to indemnify and hold PropPie harmless against claims arising from misuse of the App, breach of Terms, or unlawful activity.
15. Termination and Suspension
PropPie may suspend or terminate accounts for breach of these Terms, illegal activity, or regulatory requirements. Upon termination, access to the App will cease and data may be deleted subject to legal retention obligations.
16. Dispute Resolution and Governing Law
These Terms are governed by the laws of the Federal Republic of Nigeria. Disputes shall first be resolved amicably, failing which they shall be referred to binding arbitration in Abuja, Nigeria, under the Arbitration and Mediation Act, 2023.
17. Changes to Terms
PropPie may update these Terms from time to time. Material changes will be communicated via email or in-app notice at least fourteen (14) days before they take effect. Continued use of the App after notice constitutes acceptance.
18. Miscellaneous
- If any provision of these Terms is found invalid, the remaining provisions shall remain enforceable.
- These Terms constitute the entire agreement between PropPie and Users regarding the App.
- Notices may be sent electronically to [support email].
- The failure to enforce any right does not waive it.
19. Acceptance of Terms
By using the App, you confirm that you have read, understood, and agree to be bound by these Terms.
